Legal Terms Governing Use of TruClaimX

Acceptance of Terms

By accessing, browsing, or using TruClaimX (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue use of the Platform immediately. Your continued use of the Platform constitutes your acceptance of these Terms and any future modifications.

Platform Role

TruClaimX operates as a commercial vehicle claims intelligence network that provides VIN-linked claim records, evidence sharing, and verification services for insurers, fleets, repair facilities, and authorized partners. TruClaimX and its parent company, TrueMile LLC, do not directly own, possess, sell, or lease the vehicles referenced in claims or reports.

Records may incorporate data from third-party sources, network participants, and integrated services such as VinTruX. TruClaimX acts as a data aggregation, verification, and intelligence layer and is not a party to any insurance or repair transaction unless expressly indicated.

User Accounts

Certain features of the Platform require account registration. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may not impersonate any person or entity, misrepresent your affiliation with any person or entity, or create an account on behalf of another individual without their express authorization. TruClaimX reserves the right to suspend or terminate accounts that violate these provisions.

Claim Records & Accuracy

TruClaimX provides claim records and intelligence based on submitted data, verified VIN data, and available third-party enrichment sources. Records are informational and should not be relied upon as the sole basis for underwriting, settling, or repairing a commercial vehicle claim.

TruClaimX and TrueMile LLC do not independently guarantee the accuracy of all data points and make no representations or warranties regarding the completeness of any record. Users are encouraged to conduct their own due diligence, including independent verification, inspections, and document review.

Intellectual Property

All content, design, code, graphics, logos, trademarks, trade names, and other intellectual property displayed on the Platform are the exclusive property of TruClaimX, TrueMile LLC, or their respective licensors. No part of the Platform may be reproduced, distributed, modified, or used for commercial purposes without prior written consent from TruClaimX or TrueMile LLC.

Prohibited Activities

  • Posting fraudulent, misleading, or deceptive information or communications.
  • Scraping, harvesting, or extracting data from the Platform through automated means without express written permission.
  • Using the Platform for unauthorized commercial purposes, including reselling Platform data or services.
  • Attempting to circumvent, disable, or interfere with any security features, access controls, or safeguards of the Platform.
  • Engaging in any activity that violates applicable local, state, federal, or international law.

Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL TRUCLAIMX, TRUEMILE LLC, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

Indemnification

You agree to indemnify, defend, and hold harmless TruClaimX, TrueMile LLC, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any rights of a third party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.

Changes to Terms

TruClaimX reserves the right to modify, amend, or update these Terms at any time and at its sole discretion. Changes will be effective upon posting to the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
